AUTOMOBILE ACCIDENTS AND MICHIGAN'S NO-FAULT LAW

In Michigan automobile accidents your accident-related medical bills are paid by your own insurance company under Michigan’s No-Fault Law. 

 

Your own insurance company is generally referred to as the “first party carrier.”  Your automobile insurance company is also responsible for paying accident-related wage loss at a rate of 85% of your gross wage, up to three (3) years after the accident.  

They are also responsible to reimburse you for mileage expenses to and from care providers and for replacement services, up to $20 a day for someone to do things that you cannot do as a result of your accident-related injuries.   

 

Michigan’s new (July 2020) Automobile No-Fault law offers several options to consumers.  See New No-Fault Insurance Options.  

Wage loss and loss of service benefits are compensable for up to three (3) years from the date of accident.

NOTICE TO YOUR INSURANCE COMPANY

When an accident and accident-related claims occur, you have one (1) year within which to put your No-Fault insurance carrier on written notice.  Then you must submit claims per a no-fault claims form and release(s), and importantly, you can only recover 1-year back from the reimbursement sought.  This is generally referred to as the “One Year Back Rule.” A much stricter (shorter) notice requirement may apply in seeking uninsured or underinsured coverage under your policy. 

 

Automobile insurance policies are basically a contract between you and the insurance company, so you have to refer to the policy itself to determine the exact terms, requirements regarding notice, etc.
